Petition drive underway in Bullard to allow sale of beer and wine

BULLARD (KYTX) - The first steps in an attempt to allow the limited sale of beer and wine in the city limits of Bullard is underway.

A pro-development group in Bullard has started collecting the required number of signatures on petitions to place limited beer and wine sales, and mixed beverage restaurant sales on the November ballot for the current boundaries of the city of Bullard.

The Bullard Committee for Economic Fairness began circulating petitions last week.

The committee must gather 221 valid signatures by July 11 to have this issue placed on the November ballot.

Bullard officials will then have 30 days to verify the signatures before the petitions must be presented at the next regular meeting of the city council.

If the required number of valid signatures has been reached, officials are required to put the local option on the November ballot.

The group will be asking voters to sign petitions calling for an election to allow:

· “the legal sale of beer and wine for off-premise consumption only.” By state law this will only allow beer and wine sold in places like grocery and convenience stores. This law will not allow packaged liquor sales.

· “the legal sale of mixed beverages in restaurants by food and beverage certificate holders only.” By state law, stand alone bars, nightclubs or topless clubs cannot open under this law.

Smith County Justice of the Peace Precinct 2 voters overwhelmingly approved both measures in November 2012. However, that left parts of Bullard, which straddles the Smith County and Cherokee County line, at a disadvantage.

"It's unfair that part of our city can legally sell and part of our city cannot," said Tom Roper, committee treasurer. "It puts the southern section of our city at a huge disadvantage as far as potential growth and property values."
