Deep East Texas father charged with capital murder in connection with 4-month-old son's death

Durham's arrest comes after a medical examiner ruled that Kylo’s death was caused by "blunt force trauma to the head and torso."

LUFKIN, Texas — A Deep East Texas father has been charged with capital murder in connection with death of his 4-month-old son last October. 

Anfernee Durham, 25, of Lufkin, was booked into the Angelina County Jail Tuesday on a $1 million bond. His son Kylo Powell died in a Houston hospital on Oct. 20 after being transferred from a Lufkin hospital, police said. 

Durham's arrest comes after a medical examiner ruled that Kylo’s death was caused by "blunt force trauma to the head and torso." After getting the autopsy results, police obtained a warrant for Durham's arrest. 

According to an arrest affidavit, Kylo was described as being malnourished and "skin and bones" when he was taken to the Lufkin hospital on Oct. 17, 2023. Durham and Kylo's mother told police their son was acting abnormal and he was unresponsive that morning before he was taken to the hospital. 

Police were later told Kylo had broken ribs, a brain injury and what looked like signs of getting strangled, the affidavit said. 

The boy's mother told police about instances of her waking up to Kylo having episodes that looked like seizures and found him with blood and bodily fluids in his stool and around his mouth that would "cause alarm for any reasonable parent," the affidavit read. 

When the mother told Durham about the blood, he would reportedly tell her, "I know, lay back down." Neither Durham or the mother sought medical attention for Kylo, according to the document. Kylo's mother said Durham had an extensive history of spousal abuse and he had threatened her life when she thought about leaving him.

Both parents told police that Durham was the one who was up with Kylo and Durham woke up the boy's mother. When Durham was confronted about Kylo's non-accidental injuries by police, he showed no emotion knowing that his son may die, the document read.
