Police: Ex-Tyler ISD substitute teacher accused of touching student inappropriately in bathroom stall arrested

TYLER, Texas — An East Texas substitute teacher, accused of having an improper relationship with a minor, is behind bars.

The Smith County Sheriff's Office confirmed Davian Isaiah Hunter, 29, has been arrested for aggravated sexual assault of a child and improper relationship between an educator and a student. He was booked into the Smith County Jail on bonds totaling $500,000.

The arrest affidavit for Hunter states he was a substitute teacher within Tyler ISD when the alleged crimes occurred. 

According to the affidavit, a student reported Hunter touched him inappropriately while they were both in the same bathroom stall. Once made aware of the student's claim, Hunter was not allowed to sub on any campus pending the outcome of an investigation, the affidavit reads.

Camera footage showed Hunter follow the student into the hallway and bathroom. The student later admitted to investigators that Hunter made the student touch him inappropriately.

Video also saw the student come out of the bathroom at a fast pace and then Hunter came out after him. The student told an officer he didn't want to say anything because he was scared of Hunter, the document read. 

In a police interview, Hunter admitted that he and the student were in the same bathroom stall together and the door was shut. At one point, Hunter was standing with his back against the stall door. However, Hunter would not admit to what was alleged saying he was not an animal, the affidavit said. 

A letter obtained by CBS19 confirmed Hunter was previously at substitute at Hubbard Middle School.

The letter, sent out by Hubbard administrators, reads as follows:

"Dear Hubbard Huskies Parents, Guardians, and Staff, 

As you know, maintaining the safety and security of our students and staff while on our campus is a top priority. This includes transparent communication that involves student, staff, and school safety issues. 

We wanted to inform you that a former substitute teacher has been arrested on charges of aggravated sexual assault of a child and improper relationship with a child. The Tyler ISD Police Department has been working tirelessly with multiple agencies at the state and federal levels to aid in finding this person.

Throughout this investigation that involves a child, we have been legally bound to keep information private to allow the agencies working on the case the time to investigate the circumstances surrounding the situation and locate the person involved. What we can tell you is that this person was a substitute on our campus for six days this school year. 

From the beginning of the investigation, this person was immediately terminated and will never be allowed back on any Tyler ISD properties. This situation is unpardonable and unforgivable, and we have faith that Smith County justice will prevail.

Tyler ISD released the following statement to CBS19 regarding Hunter's arrest:

"From the beginning of the investigation, Hunter was immediately no longer a part-time employee of the district and will never be allowed back on any Tyler ISD properties. Due to the ongoing investigation involving a juvenile, the district is legally bound by state and federal laws to keep any more information confidential."
