Lindale woman accused of killing 2 people while driving intoxicated pleads guilty

SMITH COUNTY — The Lindale woman accused of killing two people in an April 2017 crash on Toll 49 pleaded guilty to two charges of intoxicated manslaughter in a Smith County court Monday.

Jessica Lauren Vass, 36, waived her right to a jury trial. She agreed to have a jury assess her sentence.

Both parties reached the decision in a plea agreement prior to Monday's hearing.

Judge Jack Skeen reiterated to Vass that according to her plea agreement it is her intent to go forward with a plea of guilty, but she reserved her right to have a jury assess her sentence in the matters.

Jury selection is scheduled to begin Monday and the trial scheduled to begin Tuesday.

Vass was indicted Aug. 24, 2017 on the two counts of intoxication manslaughter with a vehicle.

Gary McCrary, 62, of Flint, stopped to help Annette Burkhart, 56, of Garland, change a flat tire on Toll 49, north of Texas Highway 64, in Smith County.

McCrary and Burkhart were out of their vehicles on the shoulder of the roadway when a driver struck the back of one of the vehicles, pushing it into the other vehicle and ultimately both people, according to a preliminary crash investigation by the Texas Department of Transportation.

McCrary was pronounced dead at the scene, and Burkhart was taken to a Tyler hospital, where she later died.

Vass was taken to East Texas Medical Center but no injuries were cited in the report.

Speed and alcohol were cited as factors in the crash.

Vass turned herself into the Smith County Sheriff's Office June 6, 2017, after a warrant was issued for her arrest. She posted a $100,000 bond and was released the same day, according to jail records.
