Dillon Wayne Fogle was driving a pickup truck in the 800 block of Crockett Road when he struck a pedestrian and then a telephone pole, police said.

PALESTINE, Texas — An East Texas man accused of driving intoxicated and killing a pedestrian in Palestine was arrested early Friday morning.

Dillon Wayne Fogle, 39, of Elkhart, was driving a pickup truck in the 800 block of Crockett Road when he struck a pedestrian and then a telephone pole. The pedestrian, who was identified as Marcos Sanchez, 51, of Palestine, died at the scene from his injuries, according to the Palestine Police Department

Police said Fogle had the smell of alcohol emitting from his breath and officers found he was intoxicated. He was then arrested and charged with intoxicated manslaughter with a vehicle and unlawful carry of a weapon.

Further investigation showed Fogle was going north on Crockett Road when he crossed into oncoming traffic and left the roadway on the west side of the road. Witnesses told police Sanchez was taking the trash from his home to the curb when Fogle's truck struck him.

A search of Fogle's vehicle found an open alcohol container and a firearm. The investigation is ongoing, according to police.
