SMITH COUNTY, Texas — Despite Willie Mims winning the majority of votes in the Democratic Primary for Smith County Precinct 1 constable race, a judge has ordered a runoff election between appointed constable Bobby Garmon and third place finisher Curtis Traylor.

Retired Judge Jim Parsons, who heard the case on Thursday, ruled for the May 26 election between Garmon and Traylor after Mims was declared ineligible by the court.

March 3 election returns showed Mims at 1,708 votes, or 51.20% to Smith County Precinct 1 Constable Bobby Garmon’s 1,280 votes, or 38.37% and candidate Curtis Traylor’s 348 votes, or 10.43%, according to Smith County Elections Office. There is no Republican challenger in November.
